What is Probate & How Does Probate Work? Everything You Need to Know

Losing a loved one is hard enough without the added stress of navigating a legal process you never asked for. Probate can feel overwhelming, confusing, and painfully slow, especially when you’re already dealing with grief.

That’s why understanding how probate works is the first step to taking back control.

In this guide, we’ll break down what probate is, why it happens, and how to move through the process with more clarity and less frustration.

What is Probate?

Probate is the process used to ensure a deceased person’s home is properly distributed to their heirs.

In the simplest situation, this is when the legal system overrides the person’s will, determines who the person wanted to receive the home or profits from the home’s sale, and then distributes it.

Probate can be contested, it can get messy, and it can be complicated by various other factors, such as debts.

The Probate Process

The probate process can change depending on the situation.

First, you determine if there is a will or not. If there is a will, that is provided to the probate court, and the court does its best to ensure that the person’s wishes are fulfilled. This might be contested by other family members, but the goal is to ultimately distribute the property the way the owner wanted.

If there is no will, things get more complicated. The law takes over, and it distributes the property among all relevant heirs in accordance with the law.

In either case, a court-appointed administrator will oversee the distribution of the assets.

Debts can complicate the process, because the estate will be used to satisfy any outstanding debts before the money can be passed to the relevant heirs.

This is done by the administrator. After a home appraisal, they assign a value to each asset and then determine the best way to pay debts with those assets. The remaining funds are distributed according to the will or the law.

If no one has a problem with the administrator’s decisions, the process is fairly smooth. However, it can be contested. In that case, you want to have legal help to ensure you get what you’re rightfully owed, and the process gets much longer while both sides make their arguments.
